MR. MEARDON
Mr. Pepper, where were you on the evening of July 5th, 2012?

MICKEY
Stork’s Diner.

MR. MEARDON
(disappointed) Stork’s Diner? Shoot. Around what time?

MICKEY
Well, I think I got there around 8pm.

MR. MEARDON
8pm huh? You stay a while?

MICKEY
Yeah I was there for a couple of hours.

MR. MEARDON
Couple of hours?

MICKEY
Yeah.

MR. MEARDON
Hmmmm. What were you doing there?

MICKEY
I had dinner. I eat there all the time. I met with my friend Mr. Tangelo that night.

MR. MEARDON
(pointing to the defense table) Mr. Tangelo? The defendant?

MICKEY
Yessir.

MR. MEARDON
Well did he come in later, say 9 or 10?

MICKEY
Nossir, he was there when I showed up.

MR. MEARDON
When you arrived at 8?

MICKEY
Yessir.

MR. MEARDON
And he stayed with you the whole time?

MICKEY
A couple of hours, yes.

MR. MEARDON
Hmmmm. Well, dang. We should just end this thing. Case closed, as they say. That IS his alibi, And it’s looking pretty good. (clasps his hands together, looks up at the judge) Let’s just close up!

JUDGE
Counselor!

MR. MEARDON
Come on jury, give it to me straight. Innocent on all accounts! I lose, AGAIN. I’m a failure. I give up. I quit practicing. (Meardon thrusts his hands into the air when he says practicing.)

JUDGE
Are you even a licensed attorney?!

MR. MEARDON
Sorry Judge. I’m sorry. I’ve got just one more question for Mr. Pepper.

JUDGE
(sighing) Go Ahead Mr. Meardon.

MR. MEARDON
What’d you eat that night? Did you have the fried chicken?

MICKEY
Yessir.

MR. MEARDON
(glances at jury, smiles) What else are you going to get at Storks’s?

MICKEY
(giggles) It is really good.

MR. TANGELO’S COUNSEL
(annoyed) Objection Your Honor, you know, I think you’re on to something- perhaps the court needs to see some credentials from Mr. Meardon.

MR. MEARDON
Alright, alright, Mr. Pepper-they’re getting real antsy and I don’t want to go back to making sandwiches-what’d ya’ll talk about over dinner?

MICKEY
Mr. Tangelo told me he was having someone over to kill Brendan.

(A loud cough interrupts the brief silence, after which, whispers and cell phones emerge.)

MR. MEARDON
Say again? Did you tell me that Mr. Tangelo said he was having someone over to kill Brendan, right there, as you ate your fried chicken and biscuits?

MICKEY
Yessir.

(voice from audience)
YOU’RE GONNA GET IT MICKEY!!!

JUDGE
Mr. Boggs, if you don’t leave immediately, you are under arrest. (Mr. Boggs leaves with two other men.)

MR. MEARDON
Alright Mr. Pepper, did he get into detail?

MICKEY
Yeah, Mr. Tangelo told me he had this real smart plan. He said that a guy who looks a lot like him was going over to pick a fight with Brendan and take care of him.

MR. MEARDON
Take care of him
, you mean KILL him? We’re talking about July 5th? 8 pm?

MICKEY
Yeah. He told me that he even gave the guy his clothes so that some neighbors would be certain that it was him. But he figured that a couple of the real close neighbors would see the guy as a stranger and it would lead to confusion. Some witnesses would say one thing, others would say another, it would be a big mess. He told me, worst case scenario he gets 2nd degree murder and he said that he’d do 20 years to have Brendan taken care of. Easy, he said. He wasn’t even worried about that though, he was pretty sure that he was going to get off scott-free. His alibi was the only thing solid about the whole case.

MR. MEARDON
(pointing at Mickey) YOU were his alibi.

MICKEY
Yessir. He said the whole system was thwarted these days. He knew he could get away with it.

MR. MEARDON
Thwarted?

MICKEY
Yeah, that was his word.
